YOON&YANG
Family law has shown tangible changes in statutes and case law keeping pace with the changing times. The statutory regime has undergone revolutionary changes such as abolition of the traditional paternal family registration system, introduction of property division in divorce, consideration of contribution in inheritance, equalization of inheritance between men and women, establishment of guardianship for adults and court approval requirement for adoption of minors. These changes reflect the modern trends of gender equality, the increase in number of nuclear families, and prevalence of divorce. Improvement of women’s rights has also been shown in the case law which protects the rights of women in divorce by requiring less stringent grounds for divorce, awarding equal division of property, broadening the scope of marital assets to include pension payments and giving more weight to the contribution of a spouse in dividing inheritance assets.
