Yoon & Yang Holds Seminar on Greenhouse Gas Emissions Trading Scheme

On May 25, 2017, Yoon & Yang held a seminar on the topic of the greenhouse gas emissions trading scheme at its Education and Training Center on the 34th floor of ASEM Tower.
In preparation for the Second Phase (2018-2020) of the Korea Emissions Trading Scheme, Yoon & Yang organized the seminar to discuss the past trends of the emissions trading scheme during the First Phase (2015-2017) and the projections for the national emission permit allocation plan during the Second Phase.
The seminar was intended “for the audience to walk away with a great understanding of greenhouse gas emissions trading scheme after the talk by Mr. Hyeon Dong Joo, deputy director of the Ministry of Trade, Industry and Energy (MOTIE), based on his extensive field experiences, and the legal analysis by Mr. You Jin Lee, partner of Yoon & Yang, on emission permit trading,” said Ho Seung Yang, managing partner of Yoon & Yang, in his opening remarks.
The first talk was given by Mr. Hyeon Dong Joo, deputy director with the Greenhouse Gas Mitigation Team in the Ministry of Trade, Industry and Energy, on the trends and policy projections for the emissions trading scheme. Mr. Joo outlined the emissions trading scheme, discussed domestic and international developments in the field of emission permit trading, and explained how the government established the national emission permit allocation plan for the Second Phase.
The following talk by Mr. You Jin Lee, partner of Yoon & Yang, focused on potential legal issues and recent case law trends on emission permit trading. Mr. Lee, having advised the government on numerous occasions, addressed the issues that are frequently raised in administrative litigation regarding emission permit allocation. Mr. Lee emphasized that “the companies in the greenhouse gas-emitting businesses should be well informed of the recent holding that certain factors, although not explicitly provided for in the allocation guidelines, must be recognized as a valid reason for emission permit allocation in light of the legislative purposes.”
Seog-Jong Han, partner of Yoon & Yang and leader of Yoon & Yang’s Legislative Consulting & Government Relations Practice Group, concluded the seminar stating: “We hope the seminar provided the audience with an insight to better understand the future allocation plan and the policy projections for the Second Phase. We wish the audience could, when encountering any potential legal issues discussed today, find a reasonable solution with assistance from experienced experts.”
Over 80 participants including in-house counsels from major corporations in Korea attended the seminar.
